JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-02-2020 This application has been filed by the petitioner for restoration of CWJC No.11024 of 2015 which was dismissed for want of prosecution on 28.11.2018.
On query, learned counsel for the petitioner fairly admitted that so far as the writ petition is concerned, due to efflux of time, the same has become infructuous. The issue raised in the writ petition was relating to PACS election. After dismissal of the writ petition vide CWJC No.11024 of 2015,
Patna High Court MJC No.3781 of 2019(4) dt.26-02-2020 2/2 fresh election has already taken place.
In that view of the matter, no useful purpose would be served by restoring the writ petition, which has already become infructuous.
Accordingly, MJC application is dismissed.
