The petitioners seek bail in a case registered under Sections 413, 414, 379/34 of the Indian Penal Code. Allegedly, the petitioners were apprehended from the garage of one Pappu Ji from where theft motorcycle is said to have been recovered.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 28-05-2019.
Patna High Court CR. MISC. No.60015 of 2019(2) dt.24-09-2019 2/2 Charge sheet has already been submitted. The petitioners have been falsely implicated in the present case. There is no recovery of any incriminating article from possession of the petitioners. The recovery of motorcycle was made from the garage of one Pappu Ji. The petitioners were found present in the said garage. They had no knowledge that the motorcycles in question are stolen property nor they have concern with the motorcycles in question.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Motihari, East Champaran in connection with Chakia P.S.
