2. The petitioner seeks regular bail in connection with Kudhani P.S. Case No. 168/23 (O.P. Turki) G.R. 1102/23, lodged on 14.04.2023 under Sections 304B/34 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against three named accused persons including the petitioner with an allegation that the petitioner had performed love marriage with the daughter of the informant one year prior to the lodging of the present case. Subsequently, dowry demand

Patna High Court CR. MISC. No.67219 of 2023(2) dt.17-10-2023 2/3 of Rs.1,00,000/- cash and a motorcycle was made and due to non-fulfillment of the same, the daughter of the informant was not only tortured but was killed on 12.04.2023.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. In fact, the victim has committed suicide. The in-law's family members of the deceased have been intimated prior to lodging of the FIR. The antecedent of the petitioner is clean and he has been in custody since 14.04.2023. He further submits that there was one child out of the said wedlock aged about two years and there is no one to look after the said child. Therefore, a sympathetic view may be taken at the time of consideration of prayer for bail.

5. Learned counsel for the State opposes the prayer for bail and submits that it is a case under Section 304B of the I.P.C. and the petitioner is the husband of the victim.

7. In the present facts and circumstances, I am not inclined to grant regular bail to the petitioner.

8. Accordingly, the prayer for regular bail of the petitioner in connection with Kudhani P.S. Case No. 168/23 (O.P. Turki) G.R. 1102/23, pending before the learned SDJM, West Muzaffarpur, is hereby rejected.

9. However, the trial Court is directed to conclud the trial within nine months.

10. With this observation, the bail application stands disposed of.
