The petitioners are apprehending their arrest in connection with Manigachhi P.S. Case No. 168/2018, registered for the offences punishable under Sections 341, 323, 354, 354(C), 307, 504, 506 and 34 of the Indian Penal Code. Petitioner Bijay Ram had filed complaint case no. 1475/2015 against the informant of this case and others. Submission is that just to retaliate, the present F.I.R. is lodged with allegation that the petitioners were making videography while wife of the informant was bathing. Thereafter, occurrence of assault had taken place.

Considering the facts aforesaid, let the petitioners above-named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-5, Darbhanga in connection with Manigachhi P.S. Case No. 168/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
