====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-09-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Town P.S. Case No. 354 of 2019, registered under Sections 366 and 506/34 of the Indian Penal Code.

The accusation is of kidnapping of daughter of the informant by the petitioner with the help of his bother, Lal Bahu and 3-4 unknown.

Learned counsel for the petitioner submits that, in fact, daughter of the informant moved with the petitioner due to love affairs according to her own sweet will and the victim did not make any complaint about her kidnapping by the petitioner,

Patna High Court CR. MISC. No.60514 of 2019(2) dt.24-09-2019 2/2 which would appear from her statement recorded under Section 164 pf the Cr.P.C. (Annexure 2 to the petition). The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Town P.S. Case No. 354 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
