This application under Section 439(2) of the Code of Criminal Procedure has been filed by the petitioner to cancel the bail bond of opposite party no. 2, furnishing in the light of order dated 22.07.2019 passed in Sonepur P.S. Case No. 527 of 2018, whereby the court of Ist Additional Sessions Judge, Saran at Chapra, granted privilege of pre-arrest bail to the opposite party no. 2.

On perusal of the impugned order dated 22.07.2019, it appears that the learned Ist Additional Sessions Judge, Saran at Chapra has allowed the pre-arrest bail to opposite party no. 2 taking into consideration that similarly situated co-accused,

Patna High Court CR. MISC. No.62481 of 2019(2) dt.17-10-2019 2/2 Pawan Singh, was already allowed privilege of pre-arrest bail by the High Court vide Criminal Misc. No. 68543 of 2018.
