2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 191 (3) , 190, 115 ( 2 ), 118 (1) , 118 ( 2 ), 109, 351 (3) and 352 of the BNS and 27 of Arms Act.
3 . As per the prosecution case , informant namely , Priyanka devi alleged that on 08.09.2024 at about 11:00 AM, all the F.I.R. named accused persons including these petitioners came at the land of informant and started abusing and assaulting informant and in course of assault, petitioner Nos. 1 and 3
Patna High Court CR. MISC. No.65089 of 2025(2) dt.17-09-2025 2/3 assaulted informant with farsa and petitioner No. 2 and coaccused Ramesh Yadav fired which hit one boy namely , Babul Kumar.
4. It is submitted on behalf of the petitioners that on account of land dispute , for which several litigations are pending between both the parties, a simple occurrence of maarpeet took place between them in which both sides sustained injuries. Case and counter case . Though , there is allegation against petitioner No. 2 that he along with co-accused Ramesh Yadav fired upon one Babul Kumar but the injury report of Babul Kumar shows that he sustained a sharp cut injury which itself falsifies the allegation of firing against petitioner No. 2. Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, case and counter case , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
