JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Sanjhauli P. S. Case No. 38 of 2019, disclosing offences under Sections 341, 447, 323, 307, 379, 504, 34 of IPC.
So far as petitioner no.1 is concerned, there is allegation of assault by rod on the head of the informant and so far as petitioner no.2 is concerned, there is general allegation that he along with others assaulted the informant. Submission of the learned counsel for the petitioners is that they are Gotias and they have falsely been implicated in this case. There is specific allegation against petitioner no.1 of assault by rod to the informant.
The opposite party no.2 appears suo motu and
Patna High Court CR. MISC. No.60237 of 2019(2) dt.24-09-2019 2/2 submitted that there are altogether seven injuries out of which three injuries were found on the head.
Having heard both sides, considering the above submissions, so far as, petitioner no.1 is concerned, I am not inclined to grant privilege of anticipatory bail to him. He may surrender and prayer for regular bail before the learned court below.
So far as petitioner no.2 is concerned, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Bikamganj, District Rohtas, in connection with Sanjhauli P.S. Case No. 38 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
