2. The petitioner has been granted bail vide order dated 09.05.2025 passed in Cr. Misc. No. 25046 of 2025.

Learned counsel for the petitioner submits that in terms of the aforesaid order, the petitioner has furnished bail bond and as per condition of the bail order, the authority has verified the criminal antecedent of the petitioner and it was found that this petitioner is also accused in Patahi P.S. Case No. 75 of 2015. The same was not mentioned by the petitioner in bail petition. Learned counsel for the petitioner further submits that due to inadvertence, the same was not mentioned in the earlier bail petition and bail bond of the petitioner was not
Patna High Court CR. MISC. No.66822 of 2025(2) dt.18-09-2025 2/3 accepted by the learned Court below on 09.07.2025 and the petitioner has surrendered on 22.07.2025. However, the petitioner is judicial custody for about 1 year and 5 months and the co-accused persons namely, Niraj Singh @ Niraj Kumar has been granted bail by this Court vide order dated 52063 of 2022 vide order dated 27.02.2023 and co-accused persons, namely, Ranjan Kumar Singh has also been granted bail by a co-ordinate Bench of this Court vide order dated 28.06.2023 in Cr. Misc. No. 32647 of 2023 and the petitioner is in custody since 22.07.2025.
4. Learned counsel for the State has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner has concealed his criminal antecedent in his bail petition and the petitioner carries one more case other than the present one.

Considering the aforesaid facts, the petitioner had earlier granted bail by this Court and the co-accused persons have been granted bail by this Court or a co-ordinate Bench of this Hon'ble Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 11th East Champaran,
Patna High Court CR. MISC. No.66822 of 2025(2) dt.18-09-2025 3/3 Motihari, in connection with Patahi P.S. Case No. 09 of 2021,with the following conditions:- (I) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below. (II) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
(III) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
