The petitioner seeks bail in Chainpur P. S. Case No. 232 of 2018 instituted for the offence under Section(s) 341, 342, 354A, 363, 504, 506/34 of the Indian Penal Code and Section 10 of the POCSO Act, 2012 and Section 37(A) (B) of Bihar Prohibition and Excise Act, 2016 .
It is alleged in the written report that informant's daughter was returning after taking coaching classes along with her friend and while they were taking break fast in a hotel, this petitioner along with co accused Nitish Kumar Singh came on car and offered them to participate in the birthday party and thereafter they misbehaved with both the girls. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.61687 of 2018(3) dt.26-10-2018 2/2 from the written report itself it will appear that general and vague allegation has been levelled against this petitioner. Both the parties have compromised the case and good sense has prevailed. A compromise petition has been filed in the Court below which is annexed as Annexure-3 to the bail petition. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 1st Kaimur at Bhabhua, in connection with Chainpur P. S. Case No. 232 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
