JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Kotwa P.S. Case No. 152 of 2016, registered for the offences punishable under Sections 302, 120(B), 201/34 of the Indian Penal Code.

Allegedly, the father of the informant was found dead in bushes near Bum canal and it is claimed that the petitioners and other co-accused being in conspiracy have killed the father of the informant and threw the dead body in the bush. Submission is of false implication and that there is nothing besides suspicion against the petitioners, the informant

Patna High Court Cr.Misc. No.12286 of 2017 (2) dt.23-03-2017 2/2 after realizing the truth has filed compromise petition also in the Court of A.C.J.M.-10, Motihari, East Champaran vide Annexure-2 and 2/1 and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. submits that the petitioners are also named in the F.I.R.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Kotwa P.S. Case No. 152 of 2016 (G.R. No.4414 of 2016), subject to the conditions as laid down in section 438(2) of the Cr.P.C.
