JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 366A of the Indian Penal Code. Allegation is of kidnapping of Kabita Kumari, the daughter of the informant.

Submission is that Victim girl in her statement under Section 164 Cr.P.C. stated that she had voluntarily gone with the petitioner.

Considering the aforesaid fact, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II,

Patna High Court Cr.Misc. No.13313 of 2017 (2) dt.22-03-2017 2/2 Rohtas at Sasaram/Successor Court, in connection with S.T. No.466 of 2016, arising out of Darihat P.S. Case No.22 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
