JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 3 of Railway Property (Unlawful Protection) Act.

The first information report goes to show that case was registered against unknown but seizure list discloses that stolen wire was recovered from possession of the petitioner. Para 3 of the petition goes to show that petitioner does not have any criminal antecedent and is languishing in jail custody since 02.05.2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.62267 of 2019(2) dt.04-12-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate (Railway), Gaya in connection with R.P.F. Sasaram P.S. Case No. 05 of 2019.
