2. The petitioner has prayed for bail in connection with Balia P.S. Case No. 79 of 2022 registered for the offence punishable under Sections 395, 120(B) read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that the FIR named accused persons have committed dacoity. During the course of investigation, it has come that one of the accused person namely, Anand Saurav was using the SIM card of this petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. She has been falsely implicated in this case. Learned counsel for the petitioner submits that Anand Saurav, who is said to be the driver of the vehicle from which the cash was lotted has

Patna High Court CR. MISC. No.68210 of 2025(2) dt.24-09-2025 2/2 been granted bail by learned Co-ordinate Bench of this Court in Cr. Misc. No. 31955 of 2022. The case of this petitioner stands on better footing. It has also been submitted that other co-accused persons have also been granted bail by learned Co-ordinate Bench of this Court in Cr. Misc. No. 2880 of 2023 and Cr. Misc. No. 26868 of 2023. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 30.07.2025

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 79 of 2022.
