The petitioner is in custody since 30.08.2019 on his surrender in connection with Nalanda P.S. Case No. 56/2019 registered for the offence punishable under Sections 272/273 of the Indian Penal Code and 30(a) (C) of the Bihar Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner's name has surfaced on the basis of the confessional statement made before the police by one Sanjeet Kumar who was arrested on the spot and the alleged recoveries do not belong to the petitioner nor were they recovered from his conscious possession. It is further submitted that the petitioner has nothing to do with either of the accused persons, namely, Sanjeet Kumar and Sandeep Kumar and other similarly co-accused persons who have also been named by them have since been allowed regular bail by this Hon'ble Court vide Cr. Misc. No. 41661 of 2019 vide order dated 08.07.2019, Sudhir Kumar has been allowed bail vide Cr. Misc. No. 41091 of 2019 vide
Patna High Court CR. MISC. No.58293 of 2019(2) dt.16-09-2019 2/2 order dated 03.07.2019 and Mobin Khan as well as Bhaso Yadav has been granted anticipatory bail vide Cr. Misc. No. 43394 of 2019 and 40240 vide order dated 15.07.2019 and 02.07.2019. Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Addl. District and Sessions Judge, cum Spl. Judge, (Excise), Nalanda, in connection with Nalanda P.S. Case No. 56/2019. (Anjana Mishra, J) Saif/- U T
