The petitioner seeks bail in connection with Siwan P.S. Case No.254 of 2018, instituted for the offence under Sections 395 and 397 of the Indian Penal Code. It is submitted by the petitioner that petitioner has been implicated in this case on the basis of statement of coaccused, Fulena Yadav, who has been granted bail by this Court in Criminal Miscellaneous No.16664 of 2019 (An-P3). There is no recovery from the petitioner's possession and till date T.I. Parade has not been conducted to establish the petitioner's involvement. The petitioner has other criminal cases pending since before but in those cases, he is on bail.
Patna High Court CR. MISC. No.60330 of 2019(3) dt.20-11-2019 2/2 The petitioner is in custody since 03.07.2019. Learned APP for the State opposed the prayer for bail. Having considered the rival submissions of the parties, prayer for bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Siwan, in connection with Siwan P.S. Case No.254 of 2018, subject to the following conditions :- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court, if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
