====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 16-09-2025 Heard Mr. Rakesh Kumar Sinha, learned counsel appearing on behalf of the petitioner and Mr. Jharkhandi Upadhyay, learned APP for the State.

2. The present application has been filed under Section 482 of the Cr.P.C. for quashing of the order taking cognizance dated 24.01.2018 in connection with Complaint Case No. 5C of 2014, whereby cognizance has been taken by the learned Chief Judicial Magistrate, Munger under Sections 167, 219 and 323 of the Indian Penal Code.

3. It has been informed by the learned District Court vide Letter dated 29.08.2025 that the trial has already progressed and is at the stage of argument on 23.08.2025 in

Patna High Court CR. MISC. No.76255 of 2018(2) dt.16-09-2025 2/2 connection with Complaint Case No. 5C of 2014.

4. In view of the changed stage of trial, the present quashing application stands consigned with liberty to the petitioner to avail appropriate remedy.
