====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 302, 304(B)/34 of the Indian Penal Code.
3. It is a case of dowry death. As per prosecution case, daughter of the informant was married with son of these petitioners on 14.08.2023 thereafter, when she went to the matrimonial house, she was subjected to torture and harassment due to non-fulfillment of demand of dowry of Rs. 2 lacs. Subsequently, on 23.03.2024, informant got the information that his daughter was killed by pressing her neck.
4. Petitioner No. 1 is father-in-law and petitioner No.
Patna High Court CR. MISC. No.70056 of 2024(3) dt.07-01-2025 2/2 2 is mother-in-law of the deceased.
5. It is submitted on behalf of the petitioners that there is general and omnibus allegation against these petitioners. Petitioners are separate in mess and property and they are not concerned with family affairs of the deceased. Moreover, thrust of accusation is against husband of the deceased who is already in custody. Petitioners have got clean antecedent.
6. Learned APP for the State vehemently opposed the bail application.
7. Considering the fact that husband of the deceased in already in custody, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Madhubani in connection with Kaluahi P. S. Case No. 53 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
