JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The prayer for bail of the petitioner was earlier dismissed as withdrawn vide order dated 06.12.2017 passed in Cr. Misc. No. 50441 of 2017 in connection with Katihar Muffasil P.S. Case No. 114 of 2017.

Again a prayer has been made on behalf of the petitioner for grant of bail on the strength of the fact that most of the prosecution witnesses, who have been examined at the trial, have not supported the prosecution version. This Court, on an earlier occasion, had called for a report from the Trial Court about the stage of the trial. The report, which has since been received, indicates that all the prosecution witnesses have been

Patna High Court Cr.Misc. No.66823 of 2018(3) dt.12-12-2018 2/2 examined and the case is only pending for defense evidence since 29.08.2018. The report further indicates that only the defense side has sought adjournment.

From the aforesaid report, it is clear that the prosecution witnesses have been examined and it is only in the hands of the petitioner and others to have the trial proceedings concluded as early as possible.

Considering the facts aforestated, this Court is not inclined to grant bail to the petitioner above named for the present.

The Trial Court, however, is directed to conclude the proceedings and no sooner the defense evidence is closed, the proceedings be culminated by delivery of judgment.

With the aforesaid observation, the petition stands disposed off.
