The petitioner seeks pre-arrest bail in connection with Bettiah Forest 11-12 Case No. 30 F of 2011 (Trial No. 283 of 2019) registered under Sections 5, 8, 9, 10 and 13 of the Bihar Saw Mills Act, 1990.
In course of checking of running of illegal saw mill, the informant, along with other police personnel, reached in village Vaishakhwa, P.S. Gopalpur, district West Champaran, where petitioner, saw owner, Iliyas Mian, fled away from his saw mill seeing the informant and police personnel. Thereafter, saw mill was stopped and wood logs were seized. Submission is that in fact the petitioner was running the saw mill, but, later on he stopped to run the saw mill and
Patna High Court CR. MISC. No.61669 of 2019(2) dt.16-10-2019 2/2 saw mill was in abandoned condition from where wood logs are saiid to be recovered. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Bettiah Forest 11-12 Case No. 30 F of 2011 (Trial No. 283 of 2019) shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
