JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Bakhtiyarpur P.S. Case No. 41 of 2018, registered for offences punishable under Sections 461 and 379 of the Indian Penal Code.
Allegation as per F.I.R. is of commission of theft of 200 bags of rice and other articles from the shop of the informant. It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and except confession statement, there is nothing against the petitioner and though, there is recovery of half bag of rice but that has not been put on test identification parade. Further petitioner has been in judicial custody since 12.07.2018.

No.65440 of 2018(3) dt.20-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna, in connection with Bakhtiyarpur P.S. Case No. 41 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
