The contention of the writ petitioner in the instant application is that on the retirement of the petitioner on 31.08.2015, from the post of Chainman, while working under the Executive Engineer, Minor Irrigation Division, Gaya, he was paid his retiral dues. So far as pension is concerned, he received the same from 01.09.2015 to 31.12.2015 but, thereafter, as per
Patna High Court CWJC No.3782 of 2017(6) dt.03-07-2019 2/3 the petitioner, the same was stopped and as such this writ petition.
Counter affidavits have been filed by the respondents. In the counter affidavit filed on behalf of the respondent no. 6, it is stated that the petitioner had submitted an application in January, 2016, before the Treasury Officer, Rohtas, Sasaram for transferring his pension to his bank account in Punjab National Bank, Sanjohali Branch, Rohtas. Thereafter, respondent no. 6 issued letter dated 04.02.2016 to Branch Manager, Punjab National Bank, Sasaram Branch along with all the relevant documents with respect to transfer of the pension of the petitioner. It is stated that all the relevant documents have already been sent and the petitioner would get his pension from the concerned Branch, as represented by him.
The learned counsel for the petitioner submits that he has no further instructions from the petitioner since after filing of the writ application.
In view of the facts and circumstances stated hereinabove, this writ application is disposed of with a direction to respondent no. 6 to confirm/ensure that the documents sent by him have been received by Branch Manager, Punjab National Bank, Sasaram Branch and the payment of pension is started to
Patna High Court CWJC No.3782 of 2017(6) dt.03-07-2019 3/3 the petitioner from the said Branch. In case, of any difficulty in non-payment of the pension on account of not receiving of documents by the said Branch, the petitioner would approach the respondent no. 6 who would ensure the payment of the pension to the petitioner.
The writ application stands disposed of with the above observations.
