JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-04-2017 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in Shikarpur P.S. Case No. 440 of 2016 registered under Sections 363, 366A and 34 of the Indian Penal Code.

The informant alleged that when his daughter had gone to attend the call of nature, Satan Raut kidnapped his daughter. Father of Satan Raut and others abused the informant. Learned counsel for the petitioner submits that the victim appeared and made her statement under Section 164 of the Code of Criminal Procedure and she disclosed that the father of Satan Raut assaulted her mother when she had gone to attend the

Patna High Court Cr.Misc. No.14106 of 2017 (2) dt.13-04-2017 2/2 call of nature, but she did not make any allegation against the petitioner.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 440 of 2016.
