====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-09-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8(c), 21(a), 27, 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. Prosecution case, in brief, is that on 25.05.2025 at about 5 PM, a raid was conducted in which four persons were apprehended along with several syringes, drug needle, mobile phones with SIM cards, one packet smack and some cash. One of the apprehended accused disclosed the name of this petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the

Patna High Court CR. MISC. No.66856 of 2025(2) dt.23-09-2025 2/2 aforesaid recovery. Petitioner has been made accused only on the basis of confessional statement of co-accused who was apprehended on the spot. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (NDPS Act), Purnea in connection with Baisi P. S. Case No. 204 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
