2. The petitioner is apprehending his arrest in Kotwali P.S. Case No. 680 of 2023 registered under Sections 363, 366(A) and 34 of the Indian Penal Code.
3. As per allegation, the petitioner along with other coaccused persons are said to have kidnapped the minor daughter of the informant with intention to marry her.
4. Learned counsel for the petitioner has submitted that the the petitioner is innocent and has falsely been implicated in the present case. He has submitted that the victim has sworn an affidavit in which she has stated that her age is 19 years and she has solemnized marriage with the petitioner. Learned counsel
Patna High Court CR. MISC. No.69112 of 2025(2) dt.07-11-2025 2/2 has further submitted that as a result of wedlock of the couple, a child has been born.
5. Learned APP has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Kotwali P.S. Case No. 680 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure./ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
