JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Kasim Bazar P. S. Case No. 96 of 2019, disclosing offences under Sections 30/32 of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. there is allegation of recovery of liquor from the toilet of Harijan Awas and petitioner was seeing fleeing away.

Submission of the learned counsel for the petitioner is that no source of identification has been mentioned in the F.I.R. and he has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.60260 of 2019(2) dt.24-09-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-III-cum-Special Judge, Excise Act, Munger, in connection with Kasim Bazar P. S. Case No. 96 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
