JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-06-2023 The present writ petition has been filed seeking the following relief:- "I) For quashing the Notice dated 24/8/2022 issued by the Anchal Adhikari, Khajaujli Madhubani (Respondent No. 4) issued under Section 6 Sub Section 2 of the Bihar Public Land Encroachment Act, 1956 by which the petitioner has been directed to remove encroachment from the land in question (II) For also quashing the Notice dated 16/7/2022 issued by the Anchal Adhikari, Khajauli Madhubani (Respondent 4 issued under Section 3 of the Bihar Public Land No. Encroachment Act, 1956 by which the petitioner has been asked to furnish Show Cause as to why the encroachment

(III) For also restraining the Respondents from taking any coercive action of removal of residential house and other structures of the petitioner from the land in question."

At the outset, the learned counsel for the petitioner submits that the present writ petition has been rendered infructuous in view of the stand taken in the counter affidavit, filed by the Respondent-State to the effect that the encroachment proceedings initiated against the petitioner has been dropped, hence the present writ petition be disposed off. Accordingly, the present writ petition stands disposed off as not pressed.
