The petitioner seeks bail in connection with Pusa P.S. Case No.116 of 2016 registered under Sections 272 and 273/34 of the Indian Penal Code besides Sections 47, 49, 51 and 54 of the Bihar Excise (Amendment) Act, 2016.

The accusation is of recovery of recovery of 85 bottles, each containing 180 ml. Indian Made Foreign Liquor, from the house of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case and the petitioner having no criminal antecedent is in custody

Patna High Court Cr.Misc. No.13405 of 2017 (2) dt.24-03-2017 2/2 since 26.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Samastipur, in connection with Pusa P.S.
