JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Chainpur P.S. Case No. 35 of 2018, registered for offences punishable under Sections 448, 384, 386, 307, 504, 506/34 of the Indian Penal Code.

Allegation as per F.I.R is that petitioner and other accused persons came to the shop of the informant and demanded Rs. 5 lac as extortion and when the informant protested, the petitioner fired on the informant, however, he managed to save himself and further it appears that the petitioner is an accused in three more cases, out of which, two case is under Section 364(A) of the Indian Penal Code. It has been submitted on behalf of the petitioner that he has falsely been roped in this case due to land dispute and

Learned counsel for the State as well as the informant opposed the prayer for bail of the petitioner that petitioner has concealed the fact that he is accused in two more cases of other States, which will appear from the case diary itself and prayer for other co-accused persons have already been rejected by coordinate Benches of this Court vide order dated 25.06.2018 passed in Cr. Misc. No. 33968 of 2018 and vide order dated 04.10.2018 passed in Cr. Misc. No. 55472 of 2018. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
