ANJANA MISHRA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner is apprehending his arrest in connection with Amnour P.S. Case No. 136 of 2019 for the offence registered under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the main allegation is against one Priyanshu Kumar and not the present petitioner. However, learned counsel for the informant categorically submits that the petitioner exhorted the said Priyanshu Kumar to attack the father in law of the informant and, thereafter, Priyanshu Kumar made murderous attack on him. The injuries as described has been found to be grievous as

Considering the entire facts and circumstances and that the petitioner has a specific role to play in the assault, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, rejected. The aforesaid order shall not, however, prejudice the Trial Court from considering the prayer of the petitioner for grant of regular bail on its own merits.
