2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 118(1), 109(1) r/w 3(5) of the BNS.

3. The case of the prosecution in short is that the informant's son and daughter-in-law were killed by unknown miscreants. During course of investigation, one Navin Kumar was apprehended and he has given his confessional statement.

4. Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced in the confessional statement of co-accused Navin Kumar. It has also been submitted that two mobiles were recovered and one motorcycle from the place of occurrence but the said mobile phones belongs to Navin Kumar and another belongs to Sujeet Kumar. It has been submitted that similarly situated coaccused whose name has surfaced namely, Ganauri Kumar has been granted bail by the learned Co-ordinate Bench bide Cr. Misc. Case No. 43990 of 2025. The case of this petitioner stands on similar footing. The petitioner is a man of clean antecedent and is in judicial custody since 11.02.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has stated that learned trial court has recorded that there is direct and specific allegation against the accused petitioner which is against the facts and record.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Athmalgola P.S. Case No. 45 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, Patna.
