JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Yogapatti P.S. Case No. 151 of 2019, registered for the offences punishable under Sections 103, 104 of Trade Mark Act and Under Section 63, 64, 65 of the copyright Act. As per F.I.R. there is allegation against the petitioner of duplicating the cosmetic articles and selling the same. Submission of the learned counsel for the petitioner is that as a matter of fact, petitioner was preparing the articles on his house and selling it from door to door. She has been falsely implicated in this case and is ready to abide by any condition imposed on her.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above

Patna High Court CR. MISC. No.64964 of 2019(2) dt.18-10-2019 2/2 named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Bettiah, West Champaran in connection with Yogapatti P.S. Case No.- 151 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
