JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The prayer for bail of the petitioner was earlier dismissed as withdrawn vide order dated 01.12.2017 passed in Cr. Misc. No. 52506 of 2017 in connection with Kamtaul P.S. Case No. 104 of 2017.

The petitioner has again renewed his prayer for grant of bail on the ground that he has remained in custody for a long time.

This Court, on an earlier occasion, had called for a report from the Trial Court regarding the stage of the trial. The report, which has since been received, indicates that at the time of sending of the report, P.W. 3

Patna High Court Cr.Misc. No.68294 of 2018(3) dt.12-12-2018 2/2 was partly cross-examined.

Considering the period of custody of the petitioner, this Court directs the Trial Court to conclude the trial preferably within a period of one year from the date of receipt/production of a copy this order, failing which, the petitioner shall at liberty to approach this Court again for grant of bail.
