ANJANA MISHRA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.05.2019 in connection with Bettiah (Muffasil) P.S. Case No.120 of 2019 registered for the offence under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.

It is submitted by the learned counsel for the petitioner that the alleged recoveries were not from the conscious possession of the petitioner and he has been implicated on the basis of the confessional statement. It is further submitted that save and except one other case, he has no criminal antecedents. Learned counsel further submits that several other similarly situated co-accused have also been

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah (Muffasil) P.S. Case No.120 of 2019.
