2. The petitioner seeks bail in connection with Alauli P.S. Case No. 159 of 2025 instituted for the offences under Sections 191(2), 191(3), 190, 109 of the Bharatiya Nyaya Sanhita, 2023, Sections 25(1-b)a, 26, 35 of the Arms Act and Section 3/4 of the Bihar Dayen Act.
3. The prosecution case is that due to prior enmity, Chandula Devi allegedly hired 6-10 accused persons including Rudal Yadav (petitioner herein) and Dilkhush Kumar to attack
Patna High Court CR. MISC. No.67797 of 2025(2) dt.18-09-2025 2/3 Hareram Yadav. During the assault, a gunshot by Rudal Yadav injured Mithlesh Kumar, and recovery of arms and motorcycles was made from Chandula Devi's house.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. Learned counsel further submitted that the only specific allegation against the petitioner is of firing on Mithilesh Kumar but the said allegation is not supported by the injury report as the injury report suggests that the injuries sustained are simple in nature caused by hard and blunt substance. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.05.2025 and has two criminal antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, injury report as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two
Patna High Court CR. MISC. No.67797 of 2025(2) dt.18-09-2025 3/3 sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Alauli P.S. Case No. 159 of 2025.
