The petitioner is languishing in custody since 24.04.2018 in a case registered for the offences punishable under Sections 393 and 414 of the I.P.C. and under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The prosecution case as per the written report of Ajay Kumar Jha, S.H.O., University Police Station, Darbhanga submitted to the S.H.O., Sadar P.S., Darbhanga is to the effect that the informant received some secret informant to the effect that some miscreants were planning to commit robbery in the SBI, Ranipur Branch, whereupon, raid was laid and two persons

Patna High Court Cr.Misc. No.71080 of 2018(3) dt.23-01-2019 2/3 were found in suspicious condition, after seeing the police party, one accused person escaped from the scene and other accused person was apprehended by the police party. The apprehended accused person disclosed his name as Aman Kumar Jha (the petitioner). On search being made, one loaded pistol, cartridges, a motorcycle and a mobile phone were recovered from the possession of the petitioner. The petitioner also disclosed the name of the person who escaped from the scene as Suman Paswan and confessed that they had intention to commit robbery in the bank.

Learned counsel for the petitioner submits that only on the basis of suspicion, the accusation has been levelled against the petitioner. It is further submitted that apart from the present case, the petitioner was indulged in one more case in which he is on bail.

Learned APP after going through the case diary submits that arms and cartridges were recovered from the possession of petitioner.

Considering the suspicious nature of accusation, nature of recovery and period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
