The petitioner seeks bail in Special Case No. 09/2018, CIS No. 09/2018, arising out of NCB Crime No. NCB/PZU/V/32/2018, instituted for the offence under Section 20 of NDPS Act.

It is alleged in the written report that on 09.07.2018 the informant, who is Intelligence Officer, along with other officials intercepted two persons, namely, Sittu Kumar and Sunny Kumar with a Tata Sumo four wheeler. The informant after search recovered 94.400kg of Ganja from the aforesaid vehicle. The informant apprehended both accused persons. They

Patna High Court Cr.Misc. No.65640 of 2018(4) dt.28-11-2018 2/2 confessed their involvement in trafficking of aforesaid seized Ganja.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He is not named in the written report. Name of this petitioner has been disclosed by co-accused Sittu Kumar and Sunny Kumar in their confessional statement, who were apprehended by the police with Ganja. Petitioner is in custody since 04.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Purnea in Special Case No. 09/2018, CIS No. 09/2018, arising out of NCB Crime No. NCB/PZU/V/32/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
