JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-03-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For direction to the respondent SubDivisional Agriculture Officer, Begusarai, to make adjustment of the vouchers submitted by the petitioner against the advance amount paid to him for the purposes of seeds productions in the farm and for fencing work of the farm for the year, 2011-12.

(ii). To restrain the respondent authorities from taking any coercive action including recovery

(iii). For direction to the respondent SubDivisional Agriculture Officer, Begusarai and the District Agriculture Officer, Begusarai to consider the representations of the petitioner filed for adjustment of the vouchers submitted by the petitioner against the advance paid to him for the purpose of seeds productions and for fencing work and pass an appropriate order expeditiously."

At the outset, the learned counsel for the petitioner submits that during the pendency of the instant writ petition, a show cause notice dated 16.12.2023 has been issued by the Respondent No. 4 i.e. the Sub-Divisional Agriculture Officer, Begusarai, to which the petitioner has already filed a detailed reply on 31.12.2023, hence, the Respondent No. 4 be directed to consider the same and take a final decision.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Respondent No. 4 to consider the aforesaid reply filed by the petitioner and take a final decision, by passing a reasoned and a speaking order, in accordance with law, within a period of four weeks of receipt / production of a copy of this order.
