This application is for grant of regular bail in connection with Special Case No.653 of 2018 arising out of Narpatganj Bothnaha) P.S.Case No.326 of 2018 dated 3.6.2018 for the offences under Sections 30(a) of the Bihar Prohibition and Excise (Amendment Act, 2016.

Allegation against the petitioner is about recovery of 12 ltrs. of country-made liquor and further he is accused in four other cases of similar type, all the cases are of the year, 2018.

Submission of the learned counsel for the petitioner is that there is no recovery from the possession of the petitioner and in other cases also there was no recovery . He has been falsely implicated in this case on the suspicion and he

Patna High Court Cr.Misc. No.65231 of 2018(3) dt.07-12-2018 2/2 is in custody for four months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, as such the learned trial court is directed to expedite the trial, however, if the trial is not concluded within a period of four months, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
