JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This application, for grant of anticipatory bail, arises out of Mehsi P.S. Case No. 173 of 2019, disclosing offences under Section 7 of the Essential Commodities Act. As per F.I.R., there is allegation against co-accused, who was carrying two bags of wheat, he was apprehended and disclosed that he has purchase the same from the PDS shop of the petitioner.

Submission of learned counsel for the petitioner is hat he has falsely been implicated in this case on the confession of one Arvind Kumar without any verification and except that there is nothing against the petitioner and he is ready to abide by any condition imposed on him.

Heard learned A.P.P. also.

Having heard both sides, considering the submission,

Patna High Court CR. MISC. No.60206 of 2019(2) dt.24-09-2019 2/2 as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Addtiional Chief Judicial Magistrate -VI, Motihari, East Champaran, in connection with Mehsi P.S. Case No. 173 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
