The petitioner seeks regular bail in connection with Muzaffarpur Sadar (East) P.S.Case No.355 of 2017 dated 10.7.2017 registered for offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Petitioner is husband and allegation is of dowry death. Submission of the learned counsel for the petitioner is that she was suffering from illness and died due to heart attack as such the dead body was disposed of. It has further been submitted that the allegation of demand is false and some of the witnesses have also stated so. The petitioner is in custody since 1.6.2018.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.65903 of 2018(3) dt.07-12-2018 2/2 bail stating that there is allegation of demand and there is absolutely nothing in the case diary to show that she was suffering from illness and died due to heart attack. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
With the aforesaid observation, this application is dismissed.
