2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 323 , 341 , 506, 498 (A) 307 and 34 of the IPC and 3 / 4 of the D. P Act. 3 . As per the prosecution case , the marriage of the informant was solemnized with this petitioner in the year 2023
Patna High Court CR. MISC. No.70352 of 2024(3) dt.08-01-2025 2/3 and after the marriage, when she went to her matrimonial house, she was subjected to torture and cruelty by this petitioner and other in-laws family members due to non-fulfillment of demand of dowry . It is further alleged that on 04.05.2024 accused persons brutally assaulted the informant as a result of which she was severely injured and her 4 months pregnancy got terminated.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because he happens to be husband of the victim. Petitioner never demanded any dowry from the informant and allegation assault by petitioner and his family members is totally baseless and concocted. It is further submitted that when informant left her in her parental house on 05.05.2024 , she was well. Petitioner claims clean antecedent.
5 . Learned counsel for the informant opposed the prayer for bail and submitted that there is specific allegation against the petitioner that he along with other in-laws brutally assaulted the informant as a result of which she was severely injured and her 4 months pregnancy got terminated
6. Considering the nature of accusation and other circumstances of the case , prayer for pre-arrest bail of the
Patna High Court CR. MISC. No.70352 of 2024(3) dt.08-01-2025 3/3 petitioner is rejected.
