====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 02-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sadar P.S. Case No.14 of 2017 registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(a) of the Bihar Excise (Amendment) Act, 2016, pending in the court of the Chief Judicial Magistrate, Muzaffarpur.

The accusation is that in course of checking of the vehicle, two persons borne on a motorcycle were seen coming in high speed and on giving them signal to stop the motorcycle, while one person was succeeded to flee away but one person, who was driving the motorcycle, was apprehended, who disclosed his

Patna High Court Cr.Misc. No.13482 of 2017 (2) dt.02-05-2017 2/2 name as Raunak Kumar. On search of the motorcycle, 18 bottles, each containing 750 ml. Indian Made Foreign Liquor, were recovered. The apprehended accused Raunak Kumar also disclosed the name of the petitioner, who succeeded to flee away from there.

Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
