1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that similarly situated co-accused Ashish Kumar had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 56038 of 2024 and the same was allowed by an order dated 08.08.2024 with certain conditions. It is further submitted that petitioner is a student. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

Considering the submissions made by the learned counsel appearing on behalf of the petitioner and also taking into consideration the order dated 08.08.2024 in Criminal Miscellaneous No. 56038 of 2024, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Falka P.S. Case No. 91 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

5. One of the bailors of the petitioner shall be his father, Manoj Singh.

6. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not co-operating in the investigation or is not presenting himself as and when required in that event the learned Trial Court shall be at liberty to forthwith cancel the bail bonds of the petitioner.

7. It is further made clear that if charge sheet is

No.68458 of 2024(2) dt.04-10-2024 3/3 submitted against the petitioner and thereafter if the learned Trial Court comes to a conclusion that petitioner is trying to delay the trial in any manner, the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner and take all coercive steeps to ensure that petitioner is behind bar.

8. Accordingly, the instant anticipatory bail application is allowed.
