2. The present application has been preferred for grant of following reliefs:

"(i) For issuance of an appropriate writ in the nature of mandamus commanding the respondent authorities to consider the case of the petitioners for payment of compensation of their respective lands as residential land instead of agriculture land whose land has been acquired by the respondent authorities for construction of Railway Line between Muzaffarpur Sitamarhi whereby and whereunder the committee was constituted and reports have been submitted that the lands nature are residential as well as Bhitha.

ii For direction upon the respondent authorities to treat the petitioners at par with the adjacent land of the Raiyets who are being paid the compensation for their land as residential land pursuant to their representation and spot verifications.

3. The last counter affidavit of the Respondent shows that the Collector, Muzaffarpur constituted a committee headed by the Additional Collector (Relief), Muzaffarpur and wanted them to submit report. It has been stated that the matter is premature.

4. No further development has been put on record by the respondents.

5. In that background instead of keeping the case

Patna High Court CWJC No.5541 of 2017(8) dt.01-09-2025 3/3 pending, it would be appropriate that the petitioners approach the Respondent No. 6 (The District Land Acquisition Officer, Muzaffarpur) who shall be taking up the matter and after hearing the parties, reasoned order shall be passed by the 31th March, 2026.

6. Needless to add, if the petitioners are entitled to compensation and still not paid, the same shall be cleared at an earliest.
