JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 This application, for grant of anticipatory bail, arises out of Complain Case No. 219 of 2017, disclosing offences under Sections 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.

Petitioner no. 1 happens to be devar (brother in law) of the complainant and petitioner nos. 2 and 3 are cousin brothers-in-law and the allegation against them is that they in connivance with each other mutated and sold the share of land of complainant after death of her husband Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and this is out

Patna High Court CR. MISC. No.67009 of 2018(5) dt.09-04-2019 2/2 and out a case of civil nature and the complainant has also filed a case for cancellation of mutation.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge -XI-cum-Additional Chief Judicial Magistrate -II, Muzaffarpur, in connection with Complain Case No. 219 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
