The petitioner apprehends arrest in connection with Sasaram Town P.S. Case No. 571 of 2022 registered under Sections 354 and 354(b) of the Indian Penal Code and later on Section 12 of the POCSO Act was added.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner had suffered heart attack and had undergone for Angiography in C.K. Birla Hospital, Kolkata (Annexure-2). He also submits that the informant along with others assaulted the petitioner with iron rod and lathi when petitioner demanded the dues, in this regard, petitioner had also lodged the F.I.R. against

Patna High Court CR. MISC. No.67512 of 2022(2) dt.24-01-2023 2/2 the informant, as contained in Annexure-3 to the bail petition. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-VIcum-Exclusive Special Court, POCSO, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 571 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
