The petitioner, already in custody, seeks bail in connection with Complaint Case No. 15(7) of 2017/Excise Case No. 219/2016-17 registered under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Allegation in brief is that petitioner was found in drunken condition and on search 500 ml. illicit Chulai wine was also recovered from his possession.

Submission is that the petitioner was victimized by the Excise officials and the volume of liquor as alleged to have been recovered from the possession of the petitioner, is only 500 ml., and he has been in custody since 04.02.2017 and has no any criminal antecedent.

No.15376 of 2017 (2) dt.29-03-2017 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Sanjay Sharma, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Complaint Case No. 15(7) of 2017/Excise Case No. 219/2016-17.
