2. The petitioner seeks bail in Buxar Town P.S. Case No. 360 of 2024 registered for the offence punishable under Sections-191(2), 191(3), 190, 329(4), 115(2), 109 BNSS.
3. Prosecution case, in short is that in the backdrop of land dispute, the petitioner and other co-accused persons having armed with deadly weapons came to the house of inform,ant and attacked on him.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has been submitted on behalf of the petitioner that the petitioner has got clean antecedent. There is general and
Patna High Court CR. MISC. No.69133 of 2024(2) dt.07-10-2024 2/2 omnibus allegation against the petitioner. The petitioner is under incarceration since 08-07-2024. The petitioner is a man of clean antecedent.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 360 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
