Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 379, 325, 448, 504, 506 of the Indian Penal Code. The prosecution case, in brief, is that on the alleged date and time of occurrence, petitioner along with other accused persons armed with Farsa and Spade came at Darwaza of informant and co-accused Chenari Roy inflicted assault upon her causing fracture of her hand.
Learned counsel for the petitioner submits that the specific allegation of assault is against other co-accused. There is land dispute between the parties. Injuries are simple in nature.

Learned counsel for the State and the informant opposed the bail.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Mahindwara P.S. Case No. 69 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
